Arbitral tribunal

An arbitral tribunal is a private court agreed by the parties which decides disputes in place of the state courts by rendering a binding award. Its legal bases are Art. 353 et seq. CPC (domestic arbitration) and Art. 176 et seq. PILA (international arbitration); institutional proceedings follow rules such as the Swiss Rules. Compared with mediation it is heteronomous but guarantees an outcome; the award is enforceable.

Das Schiedsgericht ist ein von den Parteien vereinbartes privates Gericht, das Streitigkeiten anstelle der staatlichen Gerichte durch verbindlichen Schiedsspruch entscheidet. Rechtsgrundlagen sind Art. 353 ff. ZPO (Binnenschiedsgerichtsbarkeit) und Art. 176 ff. IPRG (internationale Schiedsgerichtsbarkeit); institutionelle Verfahren richten sich etwa nach den Swiss Rules. Gegenüber der Mediation ist es fremdbestimmt, aber ergebnissicher; der Schiedsspruch ist vollstreckbar.
