Alternative dispute resolution (ADR) is the umbrella term for conflict resolution procedures outside the state judiciary, notably negotiation, mediation, conciliation, expert determination, dispute boards and arbitration. The procedures differ in their degree of third-party control and bindingness. ADR clauses often combine them in escalation tiers. The motives are savings in time and cost, confidentiality, expertise and preservation of relationships.

Alternative Streitbeilegung (ADR) ist der Sammelbegriff für Verfahren der Konfliktlösung ausserhalb der staatlichen Gerichtsbarkeit, namentlich Verhandlung, Mediation, Schlichtung, Schiedsgutachten, Dispute Boards und Schiedsgerichtsbarkeit. Die Verfahren unterscheiden sich nach Grad der Fremdbestimmung und Verbindlichkeit. ADR-Klauseln kombinieren sie oft in Eskalationsstufen. Motive sind Zeit- und Kostenersparnis, Vertraulichkeit, Fachkompetenz und Beziehungserhalt.
