Asset tokens represent assets such as receivables, participations or claims to dividends and interest, and are economically comparable to shares, bonds or derivatives. FINMA qualifies them as securities; their issue triggers the prospectus duty under the Financial Services Act, and dealing in them commercially may require a licence as a securities firm. If they are structured as ledger-based securities under Art. 973d of the Code of Obligations, they can be transferred validly on the blockchain itself, without any written form.

Anlagetoken repräsentieren Vermögenswerte wie Forderungen, Beteiligungen oder Ansprüche auf Dividenden und Zinsen und sind wirtschaftlich mit Aktien, Obligationen oder Derivaten vergleichbar. Die FINMA qualifiziert sie als Effekten; ihre Ausgabe löst die Prospektpflicht nach FIDLEG aus, der gewerbsmässige Handel kann eine Bewilligung als Wertpapierhaus erfordern. Werden sie als Registerwertrechte nach Art. 973d OR ausgestaltet, ist die Übertragung ohne Schriftform unmittelbar auf der Blockchain rechtsgültig möglich.
