Confidentiality

Confidentiality protects the information disclosed in mediation. Statements made by the parties may not be used in subsequent court or arbitration proceedings; under Art. 216 CPC mediation is confidential and kept separate from conciliation and court proceedings. Mediators may also invoke a right to refuse cooperation as witnesses. In addition, confidentiality is regularly reinforced contractually in the agreement to mediate.

Vertraulichkeit 1038-de
Die Vertraulichkeit schützt die in der Mediation offengelegten Informationen. Aussagen der Parteien dürfen in einem späteren Gerichts- oder Schiedsverfahren nicht verwertet werden; nach Art. 216 ZPO ist die Mediation vertraulich und vom Schlichtungs- und Gerichtsverfahren getrennt. Mediatoren können sich zudem auf ein Mitwirkungsverweigerungsrecht berufen. Ergänzend wird die Vertraulichkeit regelmässig in der Mediationsvereinbarung vertraglich abgesichert.
