Court-annexed mediation

Court-annexed mediation is mediation within pending court proceedings. Under Art. 214 CPC the court may recommend mediation to the parties at any time, and the parties may jointly request it; the proceedings are stayed in the meantime. The mediation is conducted by external mediators, and the parties in principle bear the costs. An approved agreement has the effect of a final and binding decision.

Gerichtliche Mediation 1076-de
Die gerichtliche (gerichtsnahe) Mediation ist die Mediation im Rahmen eines hängigen Gerichtsverfahrens. Nach Art. 214 ZPO kann das Gericht den Parteien jederzeit eine Mediation empfehlen, und die Parteien können sie gemeinsam beantragen; das Verfahren wird einstweilen sistiert. Die Mediation wird von externen Mediatoren durchgeführt, die Kosten tragen grundsätzlich die Parteien. Die genehmigte Vereinbarung wirkt wie ein rechtskräftiger Entscheid.
