The danger is the state in which, under the given circumstances, which are generally recognisable or even known only to the perpetrator at the moment of activation of the will, there is a close possibility (probability) that the injury will occur.

Die Gefahr ist der Zustand, in dem, unter den gegebenen und im Augenblicke der Willensbetätigung allgemein erkennbaren oder auch nur dem Täter bekannten Umständen, die nahe Möglichkeit (Wahrscheinlichkeit) gegeben ist, dass der Eintritt der Verletzung erfolgen werde.
