The Data Protection Act (revFADP, in force since 1 September 2023) governs the processing of personal data of natural persons by private controllers and federal bodies. Its core elements are the processing principles (lawfulness, proportionality, purpose limitation), extended duties to inform, the register of processing activities, the data protection impact assessment, notification of data security breaches to the FDPIC, and duties backed by criminal sanctions with fines of up to CHF 250,000 against responsible natural persons.

Das Datenschutzgesetz (revDSG, in Kraft seit 1. September 2023) regelt die Bearbeitung von Personendaten natürlicher Personen durch private Verantwortliche und Bundesorgane. Kernelemente sind die Grundsätze (Rechtmässigkeit, Verhältnismässigkeit, Zweckbindung), erweiterte Informationspflichten, das Verzeichnis der Bearbeitungstätigkeiten, die Datenschutz-Folgenabschätzung, Meldung von Datensicherheitsverletzungen an den EDÖB sowie strafbewehrte Pflichten mit Bussen bis 250'000 Franken gegen verantwortliche natürliche Personen.
