Beneficial owner

The beneficial owner is the natural person to whom the assets are ultimately attributable or who ultimately controls a company (for operating companies, from a 25% share of capital or votes). Financial intermediaries must establish the beneficial owner with due diligence under Art. 4 AMLA; under company law, acquirers have notification duties under Art. 697j CO. In practice, identification is carried out using forms A, K or S of the CDB.

Wirtschaftlich Berechtigter 1105-de
Der wirtschaftlich Berechtigte ist die natürliche Person, welcher die Vermögenswerte letztlich zuzurechnen sind oder die eine Gesellschaft letztlich kontrolliert (bei Betriebsgesellschaften ab 25 % Kapital- oder Stimmanteil). Finanzintermediäre müssen ihn nach Art. 4 GwG mit der gebotenen Sorgfalt feststellen; aktienrechtlich bestehen Meldepflichten des Erwerbers nach Art. 697j OR. Die Feststellung erfolgt praxisgemäss mit den Formularen A, K oder S der VSB.
