Duty to give notice of defects

The obligation under the Swiss Code of Obligations to give notice of defects is not a positive obligation of the buyer, but rather a condition für to preserve his rights. The obligation to give notice of defects should thus provide the seller with certainty as soon as possible as to whether the goods are approved or not.

Die obligationenrechtliche Rügepflicht ist nicht positive Verpflichtung des Käufers, sondern Bedingung für die Erhaltung seiner Rechte. Die Rügepflicht soll so dem Verkäufer möglichst bald Gewissheit darüber verschaffen, ob die Ware genehmigt werde oder nicht.
