Economic freedom under Art. 27 of the Federal Constitution guarantees in particular the free choice of occupation and free access to, and exercise of, a private economic activity. It has an individual and an institutional dimension: Art. 94 binds the Confederation and the cantons to the principle of economic freedom and permits departures only where the Constitution provides for them. Restrictions require a statutory basis, a public interest and proportionality; purely economic-policy motives are not sufficient.

Die Wirtschaftsfreiheit nach Art. 27 BV gewährleistet insbesondere die freie Wahl des Berufs sowie den freien Zugang zu einer privatwirtschaftlichen Erwerbstätigkeit und deren freie Ausübung. Sie hat eine individualrechtliche und eine institutionelle Dimension: Art. 94 BV verpflichtet Bund und Kantone auf den Grundsatz der Wirtschaftsfreiheit und lässt Abweichungen nur zu, wo die Verfassung sie vorsieht. Einschränkungen bedürfen einer gesetzlichen Grundlage, eines öffentlichen Interesses und der Verhältnismässigkeit; rein wirtschaftspolitische Motive genügen nicht.
