Financial Services Act
0980-en RE430 Financial Market Law As of 11.07.2026
In force since 2020, the Financial Services Act governs the provision of financial services and the distribution of financial instruments. It requires clients to be segmented into retail, professional and institutional clients, attaches graduated duties of information, appropriateness and suitability to that segmentation, prescribes a key information document, and regulates the prospectus duty and prospectus liability. It is modelled on the European MiFID II but remains less strict. Together with the Financial Institutions Act it replaced the fragmented earlier regulation.

Das Finanzdienstleistungsgesetz regelt seit 2020 die Erbringung von Finanzdienstleistungen und den Vertrieb von Finanzinstrumenten. Es verlangt die Segmentierung der Kundschaft in Privat-, professionelle und institutionelle Kunden, knüpft daran abgestufte Informations-, Angemessenheits- und Eignungspflichten, schreibt ein Basisinformationsblatt vor und regelt Prospektpflicht und Prospekthaftung. Es lehnt sich an die europäische MiFID II an, bleibt aber weniger streng. Zusammen mit dem FINIG löste es die zersplitterte alte Regulierung ab.
