The foundation is an institution under private law, i.e. a personalised asset dedicated by a private individual to a specific purpose in the public interest under observation of the legal forms of establishment (will or public deed). Church and family foundations are not subject to state supervision.

Die Stiftung ist eine privatrechtliche Anstalt, d. h. ein personifiziertes, einem bestimmten Zwecke des Gemeinwohls unter Beobachtung der gesetzlichen Errichtungsformen (Testament oder öffentliche Beurkundung) von einer Privatperson gewidmetes Vermögen. Kirchliche und Familienstiftungen unterstehen nicht der Aufsicht des Staates.
