A generic purchase is deemed to be made if the object of purchase is determined only according to generic characteristics, i.e. only qualitatively and quantitatively. The distinction to a unit purchase plays a role in the bearing of risk as well as in the delimitation of material defects in the event of non-performance.

Um einen Gattungskauf handelt es sich, wenn der Kaufgegenstand nur nach Gattungsmerkmalen, das heisst nur qualitativ und quantitativ bestimmt ist. Die Unterscheidung zum Stückkauf spielt eine Rolle bei der Gefahrtragung sowie bei der Abgrenzung von Sachmängeln bei der Nichterfüllung.
