The inability to pay under inheritance law is not already justified by the claim that the testator left no assets; other facts must be added, such as that he/she received support, was unemployed, led an unstable life or had debts.

Die erbrechtliche Zahlungsunfähigkeit wird nicht schon durch die Behauptung begründet, der Erblasser habe kein Vermögen hinterlassen; es müssen weitere Tatsachen hinzukommen, so z. B. dass er Unterstützung empfing, arbeitslos war, ein unstetes Leben führte oder Schulden hatte.
