Intention of enrichment

The intention of enrichment is to seek a pecuniary advantage or an economic improvement. In the case of removal under value replacement, the intention to enrich cannot be given. The intended enrichment must be unlawful, i.e. the potential perpetrator must not have a legal claim to the enrichment.

Bereicherungsabsicht 0157-de
Die Bereicherungsabsicht besteht darin, einen Vermögensvorteil resp. eine wirtschaftliche Besserstellung anzustreben. Bei Wegnahme unter Wertersatz kann die Bereicherungsabsicht nicht gegeben sein. Die beabsichtigte Bereicherung muss unrechtmässig sein, d. h. der potentielle Täter darf auf die Bereicherung somit keinen Rechtsanspruch haben.
