Interdiction

Interdiction (Entmündigung) was the withdrawal of an adult person's capacity to act by the competent authority where a statutory ground existed. The institution is historical: with the adult protection law of 2013 interdiction was abolished and replaced by tailor-made deputyships; its functional counterpart today is the general deputyship (Art. 398 CC), which removes the capacity to act by operation of law.

Die Interdiktion (Entmündigung) war der Entzug der Handlungsfähigkeit einer mündigen Person durch die zuständige Behörde bei Vorliegen eines gesetzlichen Entmündigungsgrundes. Das Institut ist historisch: Mit dem Erwachsenenschutzrecht von 2013 wurde die Entmündigung abgeschafft und durch massgeschneiderte Beistandschaften ersetzt; ihr funktionales Gegenstück ist heute die umfassende Beistandschaft (Art. 398 ZGB), welche die Handlungsfähigkeit von Gesetzes wegen entfallen lässt.
