The principle of negotiation states that only the parties brought the matter in dispute into the proceedings, decide on its need for a declaratory judgment and carry out its determination, but that the Court of First Instance may not take into account facts not submitted by the parties or take evidence of its own motion.

Die Verhandlungsmaxime besagt, dass allein die Parteien den Streitstoff in den Prozess einführen, über seine Feststellungsbedürftigkeit entscheiden und seine Feststellung betreiben, dass aber das Gericht Tatsachen, welche von den Parteien nicht vorgebracht sind, nicht berücksichtigen und keine Beweise von Amts wegen aufnehmen darf.
