A non-fungible token is an individualised and therefore non-interchangeable token on a distributed ledger. It serves as digital evidence of title to artworks, collectibles, in-game items or tickets. Legally it does not automatically convey rights in the underlying work: what is transferred is the token, not necessarily the copyright, and it frequently points only to a file stored outside the ledger. After the boom of 2021 prices collapsed sharply. FINMA treats such tokens, depending on their design, as utility or asset tokens.

Nicht-fungibler Token 0939-de
Ein nicht-fungibler Token ist ein individualisierter und damit nicht austauschbarer Token auf einem verteilten Register. Er dient als digitaler Nachweis der Inhaberschaft an Kunstwerken, Sammlerstücken, Spielgegenständen oder Tickets. Rechtlich vermittelt er nicht ohne Weiteres Rechte am zugrunde liegenden Werk: Übertragen wird der Token, nicht zwingend das Urheberrecht; häufig verweist er lediglich auf eine ausserhalb des Registers gespeicherte Datei. Nach dem Boom von 2021 brachen die Preise stark ein. Die FINMA behandelt NFT je nach Ausgestaltung als Nutzungs- oder Anlagetoken.
