The obiter dictum is the consideration which, without influencing the decision in the specific case at hand, is only made in passing (incidentally). These incidental considerations in the context of a judgment are called obiter dicta.

Als obiter dictum versteht man diejenige Erwägung, welche, ohne Einfluss auf die Entscheidung des konkret vorliegenden Falles, nur nebenbei (beiläufig) angestellt wird. Diese beiläufigen Erwägungen im Rahmen eines Urteils bezeichnet man als obiter dicta.
