The objection confers the right to refuse a performance owed per se for a special reason. It serves to defend an asserted right. The objection must be asserted by a declaration of intent. A plea is, for example, the plea of limitation.

Die Einrede verleiht die Befugnis, eine an sich geschuldete Leistung aus einem besonderen Grund zu verweigern. Sie dient der Abwehr eines geltend gemachten Rechts. Die Einrede muss durch Willenserklärung geltend gemacht werden. Als Einrede gilt bspw. die Einrede der Verjährung.
