Online dispute resolution

Online dispute resolution (ODR) is the conduct of negotiation, mediation or conciliation through digital channels, ranging from video conferencing and facilitation platforms to automated settlement procedures. It lowers costs and barriers of distance but requires particular safeguards for confidentiality, data security and identification. Since the 2025 revision, the Swiss CPC expressly permits the use of electronic means for procedural acts.

Die Online-Streitbeilegung (ODR) ist die Durchführung von Verhandlung, Mediation oder Schlichtung über digitale Kanäle, von Videokonferenzen über Vermittlungsplattformen bis zu automatisierten Einigungsverfahren. Sie senkt Kosten und Distanzhürden, verlangt aber besondere Vorkehren für Vertraulichkeit, Datensicherheit und Identifikation. Die Schweizer ZPO lässt seit der Revision 2025 den Einsatz elektronischer Mittel bei Verfahrenshandlungen ausdrücklich zu.
