Putative offence

The putative offence is behaviour which the perpetrator mistakenly assumes to be an offence. It is unpunished despite the reprehensible subjective attitude of the perpetrator. The putative emergency defence is the actual error über the existence of a self-defence situation.

Das Putativdelikt ist ein Verhalten, von dem der Täter irrtümlicherweise annimmt, es stelle ein Vergehen dar. Es ist trotz der verwerflichen subjektiven Einstellung des Täters straflos. Die Putativnotwehr ist der tatsächliche Irrtum über das Vorliegen einer Notwehrlage.
