0814-en RE350 Civil Procedure Law As of 11.07.2026
The investigation maxim means that in certain cases the court may, ex officio, take into account facts not submitted by the parties and take evidence. The need to establish and establish the facts is thus independent of the parties' conduct.

Die Untersuchungsmaxime bedeutet, dass in gewissen Fällen das Gericht von Amtes wegen Tatsachen, die von den Parteien nicht vorgebracht werden, berücksichtigen und Beweise aufnehmen darf. Die Feststellungsbedürftigkeit und die Feststellung der Tatsachen ist somit vom Parteiverhalten unabhängig.
