The essence of the priority notice is that, without creating rights in rem, it gives the pre-registered legal relationship an effect similar to that of a right in rem in so far as it can also be relied on against third parties, not only those directly affected by it.

Das Wesen der Vormerkung liegt darin, dass sie, ohne dingliche Rechte zu erzeugen, dem vorgemerkten Rechtsverhältnis eine dem dinglichen Rechte ähnliche Wirkung verschafft insofern, als es auch Dritten, nicht nur den unmittelbar von ihm Betroffenen entgegengehalten werden kann.
