Settlement agreement

The settlement agreement is the written outcome of a successful mediation in which the parties record their accord. Depending on its content it is legally a settlement, a novation or a new contract and is subject to the general rules of the Code of Obligations, including any formal requirements. In pending proceedings it may be submitted to the court for approval, whereupon it takes on the effect of a final and binding decision (Art. 217 CPC).

Abschlussvereinbarung 1045-de
Die Abschlussvereinbarung ist das schriftliche Ergebnis einer erfolgreichen Mediation, in dem die Parteien ihre Einigung festhalten. Rechtlich ist sie je nach Inhalt Vergleich, Schulderneuerung oder neuer Vertrag und untersteht den allgemeinen Regeln des OR einschliesslich allfälliger Formvorschriften. In hängigen Verfahren kann sie dem Gericht zur Genehmigung eingereicht werden und erhält damit die Wirkung eines rechtskräftigen Entscheids (Art. 217 ZPO).
