The simple partnership is a community of a majority of legal entities established by obligatory contract, which pursues a common purpose with common means, which is either not a commercial business and can exist without registration in the commercial register or is not then pursued under a common name. The simple partnership is thus the contractual association of several persons or groups of persons for the purpose of achieving a common purpose with joint forces and means.

Die einfache Gesellschaft ist eine durch obligatorischen Vertrag begründete Gemeinschaft einer Mehrheit von Rechtssubjekten, welche mit gemeinsamen Mitteln einen gemeinsamen Zweck verfolgt, der entweder kein kaufmännischer Gewerbebetrieb ist und ohne Eintragung ins Handelsregister bestehen kann oder dann nicht unter gemeinsamer Firma angestrebt wird. Die einfache Gesellschaft ist somit die vertragsmässige Vereinigung mehrerer Personen oder Personengesamtheiten zur Erreichung eines gemeinsamen Zweckes mit gemeinsamen Kräften und Mitteln.
