Die Surrogation ist ein an sich auf allen Rechtsgebieten verwendbarer rechtstechnischer Vorgang, bei dem für eine Vermögensminderung nicht durch Gewährung einer nach dem Verlust neu entstehenden Geldforderung, sondern dadurch Ersatz geschaffen wird, dass an Stelle des verlorenen Vermögensteiles ein bestimmtes dingliches Recht oder ein bereits vor dem Rechtsverlust existierender obligatorischer Anspruch in das Vermögen eintritt
