Conciliation authority

The conciliation authority is the state body before which, under Art. 197 CPC, an attempt at conciliation must in principle precede every civil action (for example justices of the peace or joint boards in tenancy and employment matters). It may record a settlement, in certain cases submit proposed judgments or decide, and otherwise issues authorisation to proceed. Upon joint request, conciliation proceedings may be replaced by mediation (Art. 213 CPC).

Schlichtungsbehörde 1075-de
Die Schlichtungsbehörde ist die staatliche Stelle, vor der nach Art. 197 ZPO grundsätzlich jedem Zivilprozess ein Schlichtungsversuch vorauszugehen hat (etwa Friedensrichter oder paritätische Behörden in Miet- und Arbeitssachen). Sie kann eine Einigung beurkunden, in bestimmten Fällen Urteilsvorschläge unterbreiten oder entscheiden und stellt sonst die Klagebewilligung aus. Auf gemeinsamen Antrag kann das Schlichtungsverfahren durch Mediation ersetzt werden (Art. 213 ZPO).
