Conciliation

Conciliation is a facilitated settlement procedure in which a neutral third party promotes agreement between the parties and, unlike in mediation, usually submits a concrete settlement proposal. Under the Swiss CPC, adjudication is in principle preceded by a conciliation attempt before the conciliation authority (Art. 197 et seq. CPC); in monetary disputes up to CHF 10,000 the authority may itself submit proposed judgments or decide.

Die Schlichtung ist ein Vermittlungsverfahren, in dem eine neutrale Drittperson die Einigung der Parteien fördert und ihnen, anders als in der Mediation, in der Regel einen konkreten Lösungsvorschlag unterbreitet. In der Schweizer ZPO geht dem Entscheidverfahren grundsätzlich ein Schlichtungsversuch vor der Schlichtungsbehörde voraus (Art. 197 ff. ZPO); diese kann in vermögensrechtlichen Streitigkeiten bis 10'000 Franken selber Urteilsvorschläge machen oder entscheiden.
