Costs of mediation

The costs of mediation comprise the mediator's fee (hourly or daily rates are customary), expenses for rooms and administration, and any costs of experts involved. Absent other agreement the parties bear the costs in equal shares; the allocation is regulated in the agreement to mediate. In civil proceedings the costs of mediation are in principle a matter for the parties (Art. 218 CPC); cantonal contributions remain reserved, particularly in proceedings concerning children.

Die Mediationskosten umfassen das Honorar des Mediators (üblich sind Stunden- oder Tagessätze), Auslagen für Räume und Administration sowie allfällige Kosten beigezogener Fachpersonen. Mangels anderer Abrede tragen die Parteien die Kosten je zur Hälfte; die Kostenteilung wird in der Mediationsvereinbarung geregelt. Im Zivilprozess sind die Mediationskosten grundsätzlich Sache der Parteien (Art. 218 ZPO); vorbehalten bleiben kantonale Beiträge, insbesondere in kindesrechtlichen Verfahren.
