Expert determination

Expert determination is the contractually agreed binding determination of specific questions of fact or law by an expert third party, for example the valuation of a company or the establishment of a defect. Unlike an arbitral award, it does not decide the entire dispute and is not an enforceable title; however, the determination binds the parties and the court unless it is manifestly incorrect.

Das Schiedsgutachten ist die vertraglich vereinbarte verbindliche Feststellung einzelner Tat- oder Rechtsfragen durch eine sachverständige Drittperson, etwa die Bewertung eines Unternehmens oder die Feststellung eines Mangels. Anders als der Schiedsspruch entscheidet es nicht den ganzen Rechtsstreit und ist kein Vollstreckungstitel; die Feststellung bindet aber die Parteien und das Gericht, soweit sie nicht offensichtlich unrichtig ist.
