Greenwashing

Greenwashing is the practice of misleading investors or clients about the sustainability characteristics of products, services or companies, for example through exaggerated, unsubstantiated or deceptive sustainability claims. In Switzerland, the Unfair Competition Act, the prospectus and conduct rules of the FinSA and the self-regulation of AMAS and the Swiss Bankers Association apply; in 2024 the Federal Council refrained from issuing a dedicated greenwashing ordinance in favour of self-regulation. FINMA treats greenwashing as a supervisory issue.

Greenwashing ist die Praxis, Anleger oder Kunden über die Nachhaltigkeitseigenschaften von Produkten, Dienstleistungen oder Unternehmen zu täuschen, etwa durch übertriebene, unbelegte oder irreführende Nachhaltigkeitsversprechen. In der Schweiz greifen das UWG, die Prospekt- und Verhaltensregeln des FIDLEG sowie die Selbstregulierungen von AMAS und SBVg; der Bundesrat verzichtete 2024 auf eine eigene Greenwashing-Verordnung zugunsten der Selbstregulierung. Die FINMA behandelt Greenwashing als Aufsichtsthema.
