Mediation

Mediation is a voluntary, confidential process in which a neutral third party helps the parties resolve their conflict autonomously and by mutual agreement. Unlike a judge or arbitrator, the mediator does not decide but structures the discussion. The Swiss Civil Procedure Code expressly recognises mediation: it may replace conciliation proceedings (Art. 213 CPC), and the parties may have an approved agreement ratified with the effect of a binding decision (Art. 217 CPC).

Die Mediation ist ein freiwilliges, vertrauliches Verfahren, in dem eine neutrale Drittperson die Parteien dabei unterstützt, ihren Konflikt eigenverantwortlich und einvernehmlich zu lösen. Anders als Richter oder Schiedsrichter entscheidet die Mediatorin nicht, sondern strukturiert das Gespräch. Die ZPO anerkennt die Mediation ausdrücklich: Sie kann das Schlichtungsverfahren ersetzen (Art. 213 ZPO), und die Parteien können eine genehmigte Vereinbarung einem Entscheid gleichstellen lassen (Art. 217 ZPO).
