A smart contract is a program stored on a distributed ledger which automatically triggers a transaction once predefined conditions are met. Despite its name it is not a contract in the legal sense but a mechanism of performance; whether a contract came into existence at all is judged by the Code of Obligations. Its advantages are automation and the elimination of performance risk; its drawbacks are the inability to adapt to changed circumstances and the irreversibility of faulty execution. Coding errors have already caused losses running into billions.

Ein Smart Contract ist ein auf einem verteilten Register hinterlegtes Programm, das bei Eintritt vordefinierter Bedingungen automatisch eine Transaktion auslöst. Trotz seines Namens ist er kein Vertrag im Rechtssinn, sondern ein Ausführungsmechanismus; ob überhaupt ein Vertrag zustande kam, beurteilt sich nach dem Obligationenrecht. Vorteile sind die Automatisierung und der Wegfall des Vollzugsrisikos, Nachteile die fehlende Anpassbarkeit an veränderte Umstände und die Unumkehrbarkeit fehlerhafter Ausführung. Programmierfehler haben bereits zu Verlusten in Milliardenhöhe geführt.
