Staking is the depositing of crypto-assets in a proof-of-stake network in order to validate transactions and receive a reward for doing so. Whoever stakes assets on behalf of clients continues to hold them in custody. In 2023 FINMA made clear that staked crypto-assets can be segregated in bankruptcy only if they remain individually attributable at all times and can be returned. The user also bears the risk that his deposit will be slashed if the validator misbehaves.

Staking ist das Hinterlegen von Kryptowerten in einem Proof-of-Stake-Netzwerk, um Transaktionen zu validieren und dafür eine Vergütung zu erhalten. Wer die Werte für Kundinnen und Kunden hinterlegt, verwahrt sie weiterhin. Die FINMA stellte 2023 klar, dass gestakte Kryptowerte im Konkurs nur ausgesondert werden können, wenn sie jederzeit individuell zugeordnet sind und zurückgegeben werden können. Der Nutzer trägt zudem das Risiko, dass seine Einlage bei Fehlverhalten des Validators gekürzt wird.
