Voluntariness

Voluntariness is a core principle of mediation: the parties take part of their own accord and may terminate the process at any time without giving reasons and without legal disadvantage. The mediator may likewise end the mediation. Voluntariness concerns participation and settlement, but not ancillary contractual duties such as bearing the costs; a mediation clause may nonetheless oblige the parties to make a genuine settlement attempt.

Die Freiwilligkeit ist ein Grundprinzip der Mediation: Die Parteien nehmen aus eigenem Entschluss teil und können das Verfahren jederzeit ohne Begründung und ohne Rechtsnachteile abbrechen. Auch der Mediator kann die Mediation beenden. Die Freiwilligkeit betrifft die Teilnahme und die Einigung, nicht aber vertragliche Nebenpflichten wie die Kostentragung; eine Mediationsklausel kann immerhin verpflichten, einen Einigungsversuch zu unternehmen.
