Enforceability

Enforceability refers to the ability to enforce the settlement agreement with the assistance of state authority. Without specific measures it is an ordinary contract that must be sued upon. Enforceability can be achieved through judicial approval (Art. 217 CPC), through an enforceable public deed (Art. 347 et seq. CPC) or, for monetary claims, by drafting it as a title for provisional lifting of objection within the meaning of Art. 82 DEBA.

Vollstreckbarkeit 1046-de
Die Vollstreckbarkeit bezeichnet die Durchsetzbarkeit der Abschlussvereinbarung mit staatlichen Zwangsmitteln. Ohne besondere Vorkehr ist sie ein gewöhnlicher Vertrag, der eingeklagt werden muss. Vollstreckbarkeit lässt sich erreichen durch gerichtliche Genehmigung (Art. 217 ZPO), durch eine vollstreckbare öffentliche Urkunde (Art. 347 ff. ZPO) oder, bei Geldforderungen, durch Ausgestaltung als provisorischer Rechtsöffnungstitel im Sinne von Art. 82 SchKG.
