Whistleblowing

Whistleblowing is the reporting of misconduct, legal violations or irregularities within a company by employees or third parties, internally through reporting offices or externally to authorities or the public. Switzerland has no dedicated whistleblower protection act; permissibility is governed by the employee's duty of loyalty and the cascade principle (first internally, then to the authorities, lastly to the public). Internal reporting systems are best practice and an element of every compliance management system.

Whistleblowing ist die Meldung von Missständen, Rechtsverstössen oder Unregelmässigkeiten im Unternehmen durch Mitarbeitende oder Dritte, intern über Meldestellen oder extern an Behörden oder Öffentlichkeit. Die Schweiz kennt kein spezielles Whistleblower-Schutzgesetz; die Zulässigkeit richtet sich nach der arbeitsrechtlichen Treuepflicht und dem Kaskadenprinzip (zuerst intern, dann Behörde, zuletzt Öffentlichkeit). Interne Meldesysteme sind Best Practice und Element jedes Compliance-Management-Systems.
